Users may opt out of arbitration within 30 days of accepting these terms by emailing support@seniornicity.com with their name, address, and clear intent to opt out. If any part of this arbitration agreement is found unenforceable, the remainder stays in effect. B. CLASS ACTION WAIVER You and we agree that any dispute arising out of or related to the Site or Services is personal in nature and will be resolved solely through individual action and will not be pursued as a class arbitration, class action, or any other type of representative proceeding. GOVERNING LAW AND VENUE These Terms and Conditions are entered into in the State of California and shall be governed by and construed in accordance with the laws of the State of California, exclusive of its choice of law rules. By using the Site, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. 18\. CONSENT TO RECEIVE AND SEND EMAILS By utilizing the Seniornicity website to send or receive emails, you hereby provide your express consent to receive and transmit electronic communications, including but not limited to emails, phone calls, or other forms of electronic communication, between yourself and the individuals/entities you choose to engage with through the platform including Jantsons dba Seniornicity and its affiliates. Your consent will be retained in our records for a minimum of four (4) years and a maximum of five (5) years, in compliance with applicable laws and regulations. 19\. DISPUTES WITH SERVICE PROVIDERS Any dispute you have with a Service Provider listed on our Site is solely between you and the Service Provider. Jantsons is not responsible for resolving such disputes and will not be held liable for any losses or damages resulting from your interactions with Service Providers. However, we encourage you to report any concerns or issues to us so that we can maintain the quality of our platform. 20\. ACCOUNT DELETION AND DATA REMOVAL You may request the deletion of your account and the removal of your personal data by contacting us at support@jantsons.com. We will process your request in accordance with applicable laws and our Privacy Policy. Please note that some information may be retained for legal or operational purposes even after account deletion. 21\. CHANGES TO TERMS AND CONDITIONS Jantsons, Inc. reserves the right to modify these Terms and Conditions at any time. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions. 22\. SAM, OUR AI DIGITAL GUIDE Seniornicity offers "Sam," a digital guide powered by artificial intelligence ("Sam"). Sam is an automated software system. Sam is not a human being and is not a licensed professional of any kind. Sam is identified as a digital guide wherever it appears on the Site. Sam's responses are generated by artificial intelligence and may contain errors or inaccurate, incomplete, or outdated information. Sam's output is provided for general informational purposes only and is part of the "Content" and the "Site" for all purposes under these Terms and Conditions, including the sections titled NO PROFESSIONAL ADVICE and DISCLAIMERS AND LIMITATION OF LIABILITY. Sam does not provide medical, legal, financial, insurance, real estate, or other professional advice. You agree to independently verify any information provided by Sam with a qualified professional before acting on it, and you agree that neither Jantsons nor its affiliates, officers, directors, employees, agents, or listed Senior Transition Specialists and Home Service Providers shall be liable for any action taken or decision made in reliance on Sam's output. Any connection, introduction, or suggestion Sam makes between you and a Senior Transition Specialist or Home Service Provider is a referral only. The sections of these Terms and Conditions titled SERVICE PROVIDERS, DISCLAIMER OF LIABILITY AND ENDORSEMENT, and DISPUTES WITH SERVICE PROVIDERS apply fully to any provider you meet through Sam. Conversations with Sam may be recorded and stored as described in our Privacy Policy. In the event of any dispute regarding what Sam communicated, the stored conversation record maintained by Jantsons shall be the authoritative record. If you share information about another person with Sam, such as a parent or other family member, you represent and warrant that you have that person's consent or the legal authority to share it. Jantsons disclaims all liability arising from information submitted about another person without proper authority. If Sam offers to post a question or request to the Seniornicity Community on your behalf, the post will be made only with your approval, will contain only the version of the post you approve, and will be shown under your first name. CONSENT TO TEXT MESSAGES By providing your mobile phone number through the Site or to Sam, you expressly consent to receive text (SMS and MMS) messages from Jantsons dba Seniornicity and from the individuals or entities you choose to connect with through the platform, including account notifications, connection updates, and appointment reminders. Consent to receive text messages is not a condition of using the Site or any service. Message and data rates may apply and are your responsibility under your agreement with your wireless carrier. You may opt out at any time by replying STOP to any message, or reply HELP for assistance. Jantsons is not liable for delayed or undelivered messages or for changes made by wireless carriers. 24\. PERMITTED USE OF DIRECTORY AND MATCHING SERVICES The Seniornicity provider directory, the Seniornicity Community, and our matching services, including Sam, may be used only for the purpose of seeking, providing, or coordinating senior transition and related services. You may not: (a) scrape, harvest, copy, or download provider listings or user information, in bulk or through automated means; (b) access the Site through bots, crawlers, or other automated tools, other than standard search engine indexing; (c) compile, resell, or redistribute provider or user information; (d) use the Site to generate leads for, or otherwise benefit, a competing service; or (e) contact providers or users for any purpose other than seeking or coordinating care and related services. Jantsons may suspend or terminate access for violations of this section and may pursue all available legal remedies. 25\.
